These terms apply to the use of nrgkarting.com and purchases from NRG Karting. NRG Karting is a trading name of NRG Home & Leisure Limited (“NRG Karting”, “we”, “us” or “our”).

Nothing in these terms excludes or limits rights or remedies that cannot lawfully be excluded or limited, including applicable consumer rights.

Using the store

You may use the store only for lawful purposes. You must not introduce malicious code, interfere with security, misuse another person’s information, infringe intellectual-property rights, scrape the store unlawfully, or use the store fraudulently.

You must be legally capable of entering into the relevant contract. A parent or guardian may use the store to purchase products for a minor.

Shopify provides the ecommerce platform used to operate the store. Third-party services may be governed by their own terms and privacy notices.

Product information

We take reasonable care to keep product descriptions, images, availability and prices accurate. Screen settings and manufacturing variations may cause minor differences in colour or appearance. Measurements and compatibility information should be checked before ordering.

We may correct genuine errors. If an error materially affects an order already placed, we will contact you and offer an appropriate choice, which may include confirming the corrected order or receiving a refund.

Orders and the contract

Submitting an order is an offer to buy. An automated acknowledgement confirms receipt but does not necessarily mean the order has been accepted. A contract is formed when we confirm acceptance or dispatch the goods, depending on the wording of the order communications.

We may decline or cancel an order for a legitimate reason, including unavailability, an obvious pricing error, payment failure, suspected fraud, delivery restrictions or an unlawful transaction. If payment has been taken for an order we cancel, we will refund the relevant amount.

You are responsible for checking the order and providing accurate contact, billing and delivery information.

Prices and payment

Prices are shown in the currency stated on the store and include taxes where indicated. Delivery charges and any other applicable charges are shown before the order is submitted. International customers may also incur import taxes or charges as explained in the Shipping Policy.

Payment is processed through the payment methods offered at checkout. You confirm that you are authorised to use the selected method.

Delivery, returns and refunds

Processing, carriers, tracking, delays and international charges are covered by the Shipping Policy. Cancellation, returns, faulty goods and refunds are covered by the Return and Refund Policy. Those policies form part of these terms.

Risk of loss or damage passes as provided by applicable law. Using a delivery carrier does not remove responsibilities we owe to consumers.

Intellectual property

The store and its original content, branding, graphics and materials are owned by or licensed to us and are protected by applicable intellectual-property law. You may use the store for personal shopping and may not reproduce or commercially exploit protected material without permission.

Reviews and submissions

If you submit a review, image or other content, you confirm that you have the right to do so and that it is accurate, lawful and does not infringe another person’s rights. You give us a non-exclusive licence to display and use that content in connection with the store and our business. We may moderate or remove content where reasonably necessary, but are not obliged to publish every submission.

Third-party links

The store may link to third-party websites. We are not responsible for third-party content or services we do not control. Review the third party’s terms and privacy information before using its services.

Availability and liability

We aim to keep the store accurate, secure and available, but temporary interruptions and technical errors can occur. We do not exclude liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, breach of statutory consumer rights, or any other liability that cannot lawfully be excluded.

Subject to those protections, we are not responsible for losses that were not reasonably foreseeable when the contract was made, or for business losses arising from a consumer purchase. If you purchase wholly or mainly for business purposes, any additional limitation of liability must be interpreted subject to applicable law.

Changes to these terms

We may update these terms for future use of the store. The version applying to an order is generally the version in force when the order is placed, unless a change is required by law or agreed with you.

Governing law and disputes

These terms are governed by the applicable laws of England and Wales. If you are a consumer resident elsewhere, you retain any mandatory protections and rights to bring proceedings available under the law of your place of residence. Nothing in this section removes a right that cannot legally be removed.
